Robert F. Bain, executor of P. D. Bain, deceased, instituted this suit, in equity, against certain endorsers on a note for $27,610, in which he seeks to recover from Richard Winborne and C. E. Herbert, two of such endorsers, the sum of $6,280, with interest thereon, or if these parties are insolvent, then to recover from the remaining endorsers, defendants, their pro rata part of the amount which the complainant paid in excess of his decedents proportionate part of the indebtedness on account of the said note, with interest. The parties will sometimes hereafter be referred to as plaintiff and defendants, the relationship they bore in the trial court.
